What should I do in the first 30 days after an injury?
Get medical attention and keep going to your appointments. Report the accident to your own insurer. Write down what you remember while it's fresh. Then get legal information before you sign anything.
This is a stressful time, so here is the short version.
See a doctor, even if you think you're fine. Some injuries take days to show up. Your medical records become the backbone of any claim, so consistent treatment matters more than most people realise.
Report the accident. After a motor vehicle accident in Ontario, you're generally expected to notify your own insurer within a set time and to file an application for accident benefits within a further set time.
Write things down. The date, the time, the weather, who was there, what was said. Photos of the scene, the vehicles, the hazard, your injuries. Names and phone numbers of anyone who saw it.
Keep everything. Receipts, prescriptions, mileage to appointments, letters from the insurer, denial letters, benefit statements.
Be careful with recorded statements. An adjuster may ask you to give a recorded statement or sign a medical authorization early on. You're entitled to get legal information before you do.
Watch the clock. Ontario has time limits on injury claims, and a few of them are short. If you're unsure where you stand, it's better to ask early than late.

How we handle a case
We prepare every file properly from the start, manage the benefits and the lawsuit together, and keep you informed in plain language. You focus on your recovery; we handle the rest.
First conversation. Free, no obligation. We listen, ask questions, and tell you honestly whether we think you have a claim worth pursuing.
Opening the file. We handle the notices and applications, deal with the insurers, and take that correspondence off your plate.
Building the evidence. We coordinate with your treating doctors and, where a case calls for it, retain medical, engineering, economic or other qualified professionals to document your injuries and losses.
Managing every track. Where a claim involves more than one process, such as an accident benefits claim running alongside a lawsuit, we manage them together so that decisions in one do not undermine the other.
Resolution. Most claims settle. We prepare every file as though it will proceed to trial, so that the case is ready if negotiation doesn't produce a fair result. Where a dispute involves accident benefits, that may mean an application to the Licence Appeal Tribunal; where it involves a lawsuit, the Ontario Superior Court of Justice.

Legal fees
What does it cost to hire a personal injury lawyer?
The first consultation is free. After that, AK Lawyers works on a contingency-fee basis: you don't pay legal fees unless your claim is successful. The percentage is agreed in writing before we begin any work.
A contingency fee means our fee is a percentage of what you recover, rather than an hourly rate you pay as the case goes along. If the claim isn't successful, you don't pay us legal fees.
There is a second category of cost called disbursements: the out-of-pocket expenses of running a case, such as medical records, expert reports, court filing fees and similar. How disbursements are handled is set out in the written contingency-fee agreement you sign at the start, along with the percentage and how it's calculated. We'll go through that agreement with you before you sign it, and you can ask us anything about it.
FAQ
Common questions
Do I have a case?
It depends on whether someone else's negligence caused your injury, and on how serious the injury is. The only reliable way to find out is to have someone review the facts. That review is free.
How long will my claim take?
It varies widely. Straightforward claims can resolve in months; serious injuries often take longer, partly because it takes time to understand how someone will recover. We'd rather give you an honest estimate once we've seen the file than a number now.
Do I have to go to court?
Most claims settle without a trial. We prepare files on the basis that a trial is possible, because a case that is properly prepared is in a better position in negotiation.
What if the accident was partly my fault?
Yes. Fault does not matter for an accident benefits claim, you can access those benefits no matter who caused the crash. And you may even still be able to claim in a lawsuit (a tort claim) against the other driver. Ontario law allows for shared responsibility, so your compensation is reduced in proportion to your share rather than eliminated.
Will this cost me anything up front?
The first consultation is free. Fees are on contingency, as described above, and the details are set out in a written agreement before we start.
Is there a time limit on making a claim?
Yes. Ontario sets time limits on injury claims, and a few of them are much shorter than the general rule. Some are counted in days rather than years. The limit that applies depends on the type of claim, your accident date and, for disability claims, the wording of your policy.
My insurer already offered me money. Should I take it?
You're entitled to get legal information before you accept an offer or sign a release. Once you sign, it's usually final.
My LTD claim was denied. Is it too late?
Not necessarily, but LTD claims have deadlines and they can be shorter than people expect. If you've received a denial letter, it's worth having it looked at promptly.
